By accessing or using Chibify, you agree to be bound by these Terms of Service and all applicable laws and regulations. These terms constitute a legally binding agreement between you and Visentic LLC ("Chibify," "we," "us," or "our").
Age Requirement: You must be at least 16 years old to use Chibify. By using our service, you represent and warrant that you are at least 16 years of age. If you are under 16, you may not use Chibify under any circumstances.
Chibify provides URL shortening services and related analytics. We act solely as a technical intermediary and do not control, endorse, or assume responsibility for the content of any third-party websites that users link to through our service.
You retain ownership of the URLs and content you submit to Chibify. However, by using our service, you grant Visentic LLC a worldwide, non-exclusive, royalty-free license to use, store, and display your shortened links and associated metadata solely for the purpose of providing and improving the service.
You represent and warrant that you have all necessary rights to the content you link to, and that such content does not violate any third-party rights or applicable laws.
You agree NOT to use Chibify for:
Enforcement: We reserve the right to delete any link, suspend or terminate any account, and report illegal activity to law enforcement—all without prior notice and at our sole discretion.
Chibify respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). We act as a service provider under 17 U.S.C. § 512 and maintain a policy of terminating repeat infringers.

Chibify links redirect to third-party websites that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that Visentic LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with use of any third-party content, goods, or services available through links created using our service.
CHIBIFY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VISENTIC LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100). THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE.
You agree to indemnify, defend, and hold harmless Visentic LLC, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property, privacy, or publicity rights; (d) any content you submit, post, or transmit through the service; or (e) any claim that your content caused damage to a third party. This indemnification obligation will survive termination of these Terms and your use of the service.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Binding Arbitration: You and Visentic LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
Class Action Waiver: YOU AND VISENTIC LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
Arbitration Rules: The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in the State of Delaware, USA, or at another mutually agreed location. The arbitrator's decision will be final and binding.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@chibify.cat within 30 days of first using the service. If you opt out, you may pursue claims in court but still waive your right to participate in a class action.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Subject to the arbitration agreement above, any legal action or proceeding arising out of these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.
Chibify operates on a pay-as-you-go model. All payments are processed securely through Stripe. By making a payment, you authorize us to charge your payment method for the amounts due.
Refund Policy: Due to the nature of our service (instant delivery of digital services), all purchases are final and non-refundable. We do not provide refunds for unused credits, partially used services, or account terminations due to Terms violations.
Exceptions: If you believe you were charged in error, contact support@chibify.cat within 14 days of the charge. We will review requests on a case-by-case basis at our sole discretion.
We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms.
Upon termination, your right to use the service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnification, limitations of liability, and the arbitration agreement.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email (if you have an account) or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of Chibify after the effective date constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the service.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity of the remaining provisions, which shall continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Visentic LLC.
Visentic LLC shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, fuel, energy, labor, or materials, or failures of telecommunications or internet infrastructure.
These Terms, together with our Privacy Policy and any other legal notices published by us on the service, constitute the entire agreement between you and Visentic LLC concerning the service. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Visentic LLC regarding the service.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets. Any attempted assignment in violation of this section shall be null and void.
